Canada Trans Pacific Partnership Agreement

In 2014, linguist and political activist Noam Chomsky warned that the TPP “was designed to advance the neoliberal project of maximizing profit and supremacy and putting the world`s workers in competition with each other to reduce wages, to increase uncertainty.” [212] Senator Bernie Sanders (I-VT) argues that trade agreements such as the TPP “have destroyed families who end up working and enriched big business.” [213] Professor Robert Reich asserts that the TPP is a “Trojan horse in a global race to the bottom.” [214] [215] [216] According to the Office of the United States Trade Representation, the TPP contains “the most robust environmental commitments in history.” [90] The USTR notes that the TPP requires signatories to comply with its obligations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) in order to protect and preserve iconic species. [90] According to the USTR, the TPP is the first trade agreement banning fishing-harmful subsidies such as those that contribute to overfishing. [90] The USTR states that TPP signatories are required to “fight illegal fishing,” “promote sustainable fisheries management practices,” “protect wetlands and important natural areas,” “fight illegal wildlife trade, illegal logging and illegal fishing” and “protect the marine environment from pollution from ships , including meeting its obligations under MARPOL (an international agreement for the prevention of marine pollution).” [90] In January 2018, the UK government said it was studying membership of the CPTPP to boost exports after Brexit and held informal discussions with several members. [65] The country has an overseas territory, the Pitcairn Islands, in the Pacific Ocean. [66] In October 2018, Japanese Prime Minister Shinzo Abe said he wanted the UK to join the partnership after Brexit. [67] In a joint article with Simon Birmingham, David Parker and Chan Chun Sing, Trade Ministers of Australia, New Zealand and Singapore, UK Trade Minister Liz Truss expressed the UK`s intention to join the CPTPP. [68] The “Investments” chapter contains languages and clauses very similar to previous trade agreements, including Chapter 11 on NAFTA investments. The provisions of this agreement (IEDR) are used in the same way that the provisions of ISDS are used in NAFTA. Terms such as “Minimum Standard of Treatment,” “National Treatment” and “Indirect Expropriation” have been interpreted to give massive influence to foreign companies to challenge Canadian rules that are created in the public interest. These ISDS provisions allow foreign companies to circumvent our judicial system and demand financial compensation in secret arbitration tribunals composed of corporate lawyers with a specific interest in retaining this arbitration system.

Canadian taxpayers have paid hundreds of millions of dollars in arbitration under NAFTA, and there are billions of dollars in litigation now before these arbitration tribunals.
